Chapter 1. The fundamentals of the constitutional system
The Russian Federation – Russia is a democratic federal state with a republican form of government.
The names of the Russian Federation and Russia are equivalent.
Man, his rights and freedoms are the highest value. Recognition, observance and protection of human and citizen’s rights and freedoms is the duty of the state.
The bearer of sovereignty and the only source of power in the Russian Federation is its multinational people.
The people exercise their power directly, as well as through state authorities and local self-government bodies.
The highest direct expression of the power of the people is a referendum and free elections.
No one can appropriate power in the Russian Federation. The seizure of power or the appropriation of power is prosecuted under federal law.
The sovereignty of the Russian Federation extends over its entire territory.
The Constitution of the Russian Federation and federal laws have supremacy throughout the territory of the Russian Federation.
The Russian Federation ensures the integrity and inviolability of its territory.
The Russian Federation consists of republics, territories, regions, cities of federal significance, the autonomous region, autonomous regions – equal subjects of the Russian Federation.
The republic (state) has its own constitution and legislation. The region, the city of federal significance, the autonomous region, the autonomous okrug has its own charter and legislation.
The federal structure of the Russian Federation is based on its state integrity, the unity of the system of state power, the delimitation of powers and powers between the bodies of state power of the Russian Federation and the bodies of state power of the subjects of the Russian Federation, equality and self-determination of peoples in the Russian Federation.
In relations with federal bodies of state power, all subjects of the Russian Federation are equal to each other.
The citizenship of the Russian Federation is acquired and terminated in accordance with federal law, is unified and equal regardless of the grounds for acquisition.
Every citizen of the Russian Federation enjoys on her territory all rights and freedoms and bears equal responsibilities as provided for by the Constitution of the Russian Federation.
A citizen of the Russian Federation can not be deprived of his citizenship or the right to change it.
The Russian Federation is a social state whose policy is aimed at creating conditions that ensure a decent life and free development of a person.
Labor and health of the people are protected in the Russian Federation, a guaranteed minimum wage is established, state support for the family, maternity, paternity and childhood, disabled people and older citizens is provided, a system of social services is developed, state pensions, benefits and other social security guarantees are established.
In the Russian Federation, the unity of the economic space, the free movement of goods, services and financial resources, support for competition, freedom of economic activity are guaranteed.
In the Russian Federation, private, state, municipal and other forms of property are also recognized and protected.
Land and other natural resources are used and protected in the Russian Federation as the basis for the life and activities of peoples living in the respective territory.
Land and other natural resources can be in private, state, municipal and other forms of ownership.
State power in the Russian Federation is exercised on the basis of a division into legislative, executive and judicial. Legislative, executive and judicial bodies are independent.
- Article 11State power in the Russian Federation is exercised by the President of the Russian Federation, the Federal Assembly (the Council of Federation and the State Duma), the Government of the Russian Federation, the courts of the Russian Federation.
State power in the subjects of the Russian Federation is exercised by the bodies of state power formed by them.
The separation of powers and powers between the bodies of state power of the Russian Federation and state authorities of the constituent entities of the Russian Federation is exercised by this Constitution, the Federal and other treaties on the delimitation of powers and powers.
Article 12In the Russian Federation, local self-government is recognized and guaranteed. Local self-government is within its powers independently. The bodies of local self-government are not included in the system of public authorities.Article 13The Russian Federation recognizes ideological diversity.
No ideology can be established as a state or mandatory.
The Russian Federation recognizes political diversity, multi-party system.
Public associations are equal before the law.
It is prohibited to establish and operate public associations whose goals or actions are aimed at violently changing the foundations of the constitutional system and violating the integrity of the Russian Federation, undermining the security of the state, creating armed groups, inciting social, racial, national and religious hatred.
The Russian Federation is a secular state. No religion can be established as a state or compulsory religion.
Religious associations are separated from the state and are equal before the law.
The Constitution of the Russian Federation has the highest legal force, direct effect and is applied throughout the territory of the Russian Federation. Laws and other legal acts adopted in the Russian Federation should not contradict the Constitution of the Russian Federation.
The bodies of state power, local self-government bodies, officials, citizens and their associations are obliged to observe the Constitution of the Russian Federation and laws.
Laws are subject to official publication. Unpublished laws do not apply. Any normative legal acts affecting the rights, freedoms and duties of a person and citizen can not be applied unless they are officially published to the public.
The universally recognized principles and norms of international law and international treaties of the Russian Federation are an integral part of its legal system. If the international treaty of the Russian Federation establishes other rules than those provided for by law, the rules of the international treaty are applied.
The provisions of this chapter of the Constitution form the basis of the constitutional system of the Russian Federation and can not be changed except in the manner established by this Constitution.
No other provisions of this Constitution can contradict the fundamentals of the constitutional system of the Russian Federation.
